Montenegrin court postpones Do Kwon’s extradition to South Korea

On August 8, 2024, the Montenegrin Supreme Court delayed the extradition of Do Kwon, the co-founder of Terraform Labs, to South Korea.

 

This decision was made in response to a request from the Supreme State Prosecutor’s Office, which called for a review under the “protection of legality” procedure.

 

The court has postponed the extradition until it can thoroughly examine whether the conditions for extradition were legally met by the lower courts.

 

This delay marks the second time this year that Montenegro's Supreme Court has halted Kwon's extradition.

 

Earlier, in June, the High Court in Podgorica ruled in favor of extraditing Kwon to South Korea rather than the United States, which also seeks his extradition on fraud charges related to the collapse of Terra and its associated stablecoin.

 

Do Kwon has been in Montenegrin custody since March 2023 after being arrested for attempting to travel with falsified documents.

 

The court's decision to delay the extradition leaves the situation uncertain, with both South Korea and the United States vying for jurisdiction to try Kwon on multiple criminal charges.

 

The Supreme Court’s final decision on this matter is expected to be made within the legal deadlines, but no specific date has been provided
